Copyright Policy

ZTUDIO respects the intellectual property rights of others and expects our users to do the same. We will respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA).

It is our policy to terminate the accounts of users who are repeat infringers of copyrighted material.

Filing a DMCA Takedown Notice

If you believe that content on Truth or Touch® infringes your copyright, you may submit a takedown notice. Your notice must include all of the following information:

Required Information

  1. Identification of the copyrighted work: Describe the copyrighted work that you claim has been infringed, or if multiple works, provide a representative list.
  2. Identification of the infringing material: Identify the material that you claim is infringing and provide enough detail for us to locate it (e.g., specific URLs, user profiles, or content identifiers).
  3. Your contact information: Include your name, address, telephone number, and email address.
  4. Good faith statement: Include a statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement: Include a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.
  6. Physical or electronic signature: Include your physical or electronic signature.

Important: Filing a false DMCA notice may result in liability for damages, including court costs and attorney fees. Please ensure your claim is valid before submitting.

Please send your complete DMCA notice to our designated agent using the contact information above. Incomplete notices may not be processed.

Counter-Notification Process

If you believe your content was removed in error or misidentification, you may file a counter-notification. Your counter-notification must include:

  1. Identification of the removed content: Identify the content that was removed and the location where it appeared before removal.
  2. Good faith statement: A statement under penalty of perjury that you have a good faith belief that the content was removed as a result of mistake or misidentification.
  3. Your contact information: Your name, address, telephone number, and email address.
  4. Consent to jurisdiction: A statement that you consent to the jurisdiction of the federal court in [jurisdiction] and that you will accept service of process from the person who provided the original notification.
  5. Physical or electronic signature: Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If they do not file a court action within 10 business days, we may restore the removed content.

Repeat Infringer Policy

We maintain a policy of terminating accounts of users who are determined to be repeat infringers. Factors we consider include:

  • Number of valid DMCA notices received against a user
  • Pattern of infringing behavior
  • Response to previous warnings or notices
  • Nature and severity of the infringement

Safe Harbor Compliance

ZTUDIO qualifies for safe harbor protections under the DMCA. We:

  • Do not have actual knowledge of infringing activity
  • Are not aware of facts or circumstances from which infringing activity is apparent
  • Do not receive a financial benefit directly attributable to infringing activity
  • Respond expeditiously to remove or disable access to infringing material upon notice
  • Have adopted and reasonably implemented a policy for termination of repeat infringers

False Claims and Misrepresentation

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that:

  • Material or activity is infringing, or
  • Material or activity was removed or disabled by mistake or misidentification

shall be liable for any damages, including costs and attorneys' fees, incurred by the alleged infringer or service provider who is injured by such misrepresentation.
